Terms of Service
Effective Date: October 16, 2026
Last Updated: October 16, 2026
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of XeniaCore's website, billing system, hosting services, control panel, and related products.
“XeniaCore,” “we,” “us,” and “our” refer to the operator of XeniaCore. “Customer,” “you,” and “your” refer to any individual or entity that accesses or purchases our services.
By creating an account, placing an order, making a payment, or using our services, you agree to these Terms, our Privacy Policy, our Fair Use Policy, and any applicable Purchase Agreement.
If you do not agree to these Terms, do not purchase or use our services.
2. Services
XeniaCore provides online hosting services, which may include:
- Game server hosting: hosting for supported multiplayer games and related server software.
- Website hosting: hosting for customer websites, including supported PHP applications, domain configuration, DNS management, and automatic HTTPS where supported.
- Discord bot hosting: hosting for supported Discord bots and associated applications.
- Additional services: other hosting products or related services that we may introduce.
Available products, features, locations, prices, and resource allocations are those shown in our billing system when you place an order. A product described on our public website is not necessarily available for purchase until it is listed for sale.
We may change, add, discontinue, or modify services and features, subject to applicable law and any commitments already made to customers.
3. Eligibility and Accounts
You must have the legal capacity to enter into an agreement to purchase our services. If you are under the age of majority where you live, you may use paid services only with the involvement and authorization of a parent or legal guardian where required by law.
You must provide accurate account, billing, and contact information and keep it updated.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.
You may not impersonate another person, submit fraudulent information, or create accounts to evade a suspension or termination.
4. Orders and Provisioning
Orders are placed through our billing system. Depending on the product, you may need to provide a domain name, application information, or other configuration details.
Payment does not guarantee that every requested configuration is technically possible. We may contact you to correct invalid information or resolve a provisioning issue.
Where automated provisioning is available, we may create your service and associated control-panel account after payment is confirmed. Provisioning times may vary due to technical problems, capacity, payment verification, or information supplied by you.
If we cannot provide an ordered service, we will work with you to resolve the issue or provide an appropriate refund where required by our published refund policy or applicable law.
5. Pricing and Payments
Prices, billing intervals, resource allocations, and product descriptions are displayed during checkout.
Payments may be processed by third-party payment providers, including Stripe and PayPal, when available. Your payment may also be subject to the applicable provider's terms.
You authorize us and our payment providers to charge the payment method you select for the amount and billing interval disclosed during checkout.
For recurring subscriptions, charges may continue until the subscription is cancelled. You are responsible for keeping your payment method valid and your billing information current.
We may change prices for future billing periods after providing notice where required by law or applicable provider rules. A price change will not retroactively change a payment already completed.
We may suspend a service when payment is overdue, disputed, declined, or otherwise not successfully completed. Any applicable grace period will be communicated through our policies, billing system, or notices.
6. Cancellations and Refunds
You may request cancellation through the available billing-system controls or by contacting support.
Unless a different term is disclosed at checkout or required by law, cancellation stops future renewals and does not automatically entitle you to a refund for a billing period that has already started.
Refund eligibility is governed by our published refund policy, the applicable Purchase Agreement, the terms disclosed at checkout, and applicable law.
We do not waive any refund or cancellation rights that cannot legally be waived.
If you believe a payment is incorrect, contact us promptly so we can investigate.
7. Chargebacks and Payment Disputes
If you have a billing concern, please contact XeniaCore before initiating a payment dispute so that we can attempt to resolve it.
We may temporarily suspend services associated with a suspected fraudulent transaction or a payment reversal while investigating the matter.
We may terminate an account where we reasonably determine that fraud, payment abuse, or repeated improper payment disputes have occurred, subject to applicable law and payment-provider requirements.
Nothing in this section prevents you from exercising rights provided by law or your payment provider.
8. Acceptable Use
You may use our services only for lawful purposes and in accordance with these Terms and our Fair Use Policy.
You must not use our services to:
- Conduct illegal activities or facilitate criminal conduct.
- Distribute malware, malicious scripts, or other harmful software.
- Launch unauthorized attacks, scans, or disruptions against systems you do not own or have permission to test.
- Send spam, conduct phishing, or distribute deceptive communications.
- Infringe intellectual property rights or violate another person's privacy.
- Exploit vulnerabilities in our infrastructure or other customers' services.
- Interfere with the stability, security, or performance of our network or systems.
- Evade resource limits, security controls, account restrictions, or suspensions.
- Operate services that violate applicable law or the rules of our infrastructure or payment providers.
Additional service-specific restrictions are described in the Fair Use Policy.
9. Resource Limits and Fair Use
Each service is subject to the specifications, resource allocations, and usage restrictions shown in its product description and our Fair Use Policy.
We may investigate excessive or abusive resource consumption, unusual network activity, security threats, and behavior that adversely affects other customers.
Where reasonably necessary to protect our infrastructure or customers, we may restrict resource usage, suspend a service, or require corrective action.
We will use reasonable judgment when enforcing these restrictions and will provide notice where practical, except where immediate action is needed to address a security threat, abuse, or legal obligation.
10. Website Hosting, Domains, and DNS
For website hosting, you are responsible for owning or having permission to use the domain name and all content you publish.
Where DNS management is provided, you authorize XeniaCore to create, modify, or remove DNS records needed to deliver the service you request.
You are responsible for configuring your domain registrar to use the correct nameservers and for maintaining accurate domain ownership and contact information.
DNS propagation, registrar processing, certificate issuance, and external network conditions may delay website availability or HTTPS activation.
We cannot guarantee that every domain, DNS configuration, application, or third-party service will be compatible with our platform.
You remain responsible for domain registration and renewal fees unless a product explicitly states otherwise.
11. Customer Content and Backups
You retain ownership of content and materials that you upload or create, subject to any rights needed to operate the service.
You grant XeniaCore permission to store, process, transmit, and display your content only as reasonably necessary to provide, secure, maintain, and support the services.
You are responsible for ensuring that you have the necessary rights to all content you upload.
Unless a product explicitly includes a backup service with stated terms, you are responsible for maintaining independent copies of important data. We do not guarantee that all files, databases, configurations, or server data can be recovered following deletion, failure, suspension, or termination.
Do not treat hosting storage as your only backup.
12. Third-Party Services
Our services may rely on third parties, including infrastructure providers, domain registrars, payment processors, control-panel software, DNS systems, and external APIs.
Third-party services are subject to their own terms, availability, and technical limitations. We are not responsible for independent third-party outages or actions beyond our reasonable control, although we will make reasonable efforts to address issues affecting our services.
13. Service Availability and Maintenance
We aim to provide reliable hosting, but we do not guarantee uninterrupted or error-free service unless a separate written service-level agreement expressly provides otherwise.
Downtime may occur due to maintenance, infrastructure failures, network problems, security incidents, upstream-provider issues, or circumstances outside our control.
We may perform maintenance, apply security updates, or temporarily restrict access when reasonably necessary to maintain or protect our services.
Any uptime figures or performance descriptions are estimates or targets unless explicitly identified as binding contractual guarantees.
14. Suspension and Termination
We may restrict, suspend, or terminate services when reasonably necessary because of:
- Violations of these Terms or the Fair Use Policy.
- Fraudulent, reversed, overdue, or otherwise invalid payments.
- Security threats, abuse, or illegal activity.
- Material risk to our infrastructure, customers, or third parties.
- A legal requirement or an instruction from an applicable provider.
- Discontinuation of a product or a material operational necessity.
Where practical, we will provide notice and an opportunity to correct a violation. We may act without prior notice when immediate action is reasonably necessary to protect security, prevent abuse, comply with law, or limit damage.
Upon termination, access to the affected service may end and stored data may be deleted according to our retention practices and applicable law. You are responsible for exporting your data before termination whenever access remains available.
Termination does not eliminate payment obligations that accrued before termination.
15. Intellectual Property
XeniaCore's branding, website design, original software, documentation, and other materials owned by XeniaCore remain our property or the property of our licensors.
You may not copy, resell, modify, or redistribute our proprietary materials except as permitted by law or with our written permission.
You retain rights to your own content and are responsible for ensuring that your use of third-party software complies with its license.
16. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our services are provided on an “as available” and “as is” basis, except for warranties that cannot legally be excluded.
We do not guarantee that every service will be uninterrupted, secure against every threat, compatible with every application, or free of errors.
Nothing in these Terms excludes a warranty or consumer right that applicable law prohibits us from excluding.
17. Limitation of Liability
To the maximum extent permitted by applicable law, XeniaCore will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from your use of our services.
To the maximum extent permitted by applicable law, XeniaCore's total liability for claims arising from a particular service will not exceed the amount you paid to XeniaCore for that service during the three months preceding the event giving rise to the claim.
These limitations do not apply where prohibited by law, including liability that cannot legally be limited or excluded.
You are responsible for maintaining appropriate backups and for determining whether a service meets your requirements before relying on it for critical operations.
18. Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, and reasonable costs arising from your unlawful use of the services, your infringement of another person's rights, or your material violation of these Terms.
This provision does not require you to indemnify XeniaCore for our own conduct to the extent such a requirement would be unlawful.
19. Changes to These Terms
We may update these Terms to reflect changes in our services, operations, legal obligations, or business practices.
The updated version will be published with a revised “Last Updated” date. Where required by law, we will provide notice or obtain renewed consent.
Your continued use of the services after changes take effect constitutes acceptance only to the extent permitted by applicable law.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
Disputes will be handled by courts with appropriate jurisdiction, subject to any mandatory consumer-protection laws or other legal rights that apply to you.
Nothing in this section prevents either party from exercising rights that cannot legally be waived.
