Purchase Agreement

Effective Date: October 16, 2026
Last Updated: October 16, 2026

This Purchase Agreement ("Agreement") governs purchases of hosting services from XeniaCore ("XeniaCore," "we," "us," or "our").

It applies to orders placed through our billing website, including https://billing.xeniacore.com, and covers game server hosting, website hosting, Discord bot hosting, and any other hosting products expressly offered by XeniaCore.

This Agreement supplements the XeniaCore Terms of Service, Privacy Policy, and Fair Use Policy.

1. Agreement to Purchase

By completing a purchase through XeniaCore's billing system, you acknowledge that:

  1. You have reviewed and agree to this Purchase Agreement.
  2. You have reviewed or been provided access to our Terms of Service, Privacy Policy, and Fair Use Policy.
  3. The information provided during checkout is accurate to the best of your knowledge.
  4. You are authorized to use the payment method submitted for the purchase.
  5. You understand the service, price, billing interval, and applicable limitations presented at checkout.
  6. You agree to pay the applicable charges for the selected service.

Acceptance at checkout: Before submitting payment, you must be presented with this Agreement or a clearly identified link to it and be given a reasonable opportunity to review it. By clicking the applicable purchase or payment confirmation control and completing the order, you agree to this Agreement, subject to applicable law.

Where required by law, XeniaCore will obtain separate affirmative consent for particular terms, recurring charges, or other disclosures.

Merely visiting the website, browsing plans, or creating an account without completing a purchase does not, by itself, constitute acceptance of this Purchase Agreement.

2. Customer and Order Details

The order-specific details are those shown in your billing account, invoice, and checkout confirmation.

These may include:

  • Customer name or account identifier.
  • Purchased service and plan.
  • Allocated resources and included features.
  • Service location.
  • Initial purchase price.
  • Applicable taxes and fees.
  • Billing interval and renewal terms, if applicable.
  • Order date and payment status.

The order confirmation and invoice form part of this Agreement for the relevant purchase.

If an order-specific term conflicts with this Agreement, the order-specific term controls only for that particular purchase and only to the extent the difference is clearly disclosed and legally enforceable.

3. Payment Authorization

You authorize XeniaCore and its designated payment processor to process the payment associated with your order.

Payment processing is subject to the payment provider's applicable terms, verification procedures, and security requirements.

You must use a valid payment method that you are authorized to use.

XeniaCore may decline or delay an order when payment cannot be verified, fraud is reasonably suspected, or fulfillment would violate applicable law or our published policies.

4. Payment in Full and Provisioning

Unless your order expressly states otherwise, the full amount due must be successfully paid before your service is provisioned.

Once payment is confirmed, XeniaCore may automatically create your service and make it available through the control panel at https://panel.xeniacore.com.

Provisioning is subject to resource availability, technical requirements, and the successful operation of our systems and service providers.

If a service cannot be provisioned, XeniaCore will review the order and provide an appropriate resolution consistent with the Terms of Service and applicable law.

An incomplete, declined, pending, reversed, or unauthorized transaction does not satisfy the requirement to pay in full.

5. Recurring Billing and Renewals

If your selected service is a subscription, the renewal interval, price, and relevant terms will be disclosed at checkout.

By completing a subscription purchase, you authorize recurring charges at the disclosed interval until you cancel or the subscription otherwise ends.

You are responsible for maintaining a valid payment method and canceling before renewal if you do not wish to continue the subscription.

XeniaCore will provide any required renewal notices, cancellation mechanisms, and disclosures under applicable law.

If a payment fails, XeniaCore may retry payment where permitted, notify you of the failure, and suspend the affected service in accordance with the Terms of Service and applicable law.

6. Service Specifications

Your purchase includes only the resources, features, and service period described in the selected plan and order confirmation.

Services may include game server hosting, website hosting, Discord bot hosting, control panel access, DNS management, HTTPS configuration, and other features expressly listed for the selected plan.

Features not included in the order are not guaranteed.

Unless expressly stated in writing, XeniaCore does not guarantee a specific level of game performance, player capacity, website traffic, bot activity, or application compatibility beyond any specifications explicitly included in the purchase.

7. Customer Responsibilities

You are responsible for:

  • Providing accurate account and billing information.
  • Securing account credentials, API keys, tokens, and passwords.
  • Ensuring your hosted content is lawful and appropriately licensed.
  • Configuring and maintaining your applications.
  • Complying with the Terms of Service and Fair Use Policy.
  • Maintaining backups unless backups are expressly included in your plan.
  • Keeping payment information current for recurring services.
  • Reviewing order details before submitting payment.

You must not use the purchased services to conduct fraud, distribute malware, attack third-party systems, violate intellectual property rights, or engage in prohibited activities.

8. Cancellations

You may request cancellation using the billing system or another official method designated by XeniaCore.

For subscriptions, cancellation generally prevents future renewals once effective under the applicable billing terms.

Unless required by law or expressly stated in the order, cancellation does not automatically entitle you to a refund for the current billing period.

You remain responsible for charges incurred before cancellation takes effect and any outstanding amounts lawfully due.

9. Refunds

Refund eligibility is determined by the XeniaCore Terms of Service, any applicable refund policy or written guarantee, the order terms, and applicable law.

Unless otherwise stated or legally required, fees for services already provisioned or made available are generally non-refundable.

This provision does not waive statutory cancellation rights, mandatory refund rights, or other protections that apply to your purchase.

If XeniaCore is unable to deliver a purchased service, you may contact support for review and an appropriate remedy.

10. Chargebacks, Reversals, and Fraud

You should contact XeniaCore support if you believe a charge is incorrect or if you experience a billing issue.

Fraudulent chargebacks, deliberate payment manipulation, and substantiated attempts to obtain services without payment may result in suspension, termination, or account banning, where permitted by law.

A payment reversal or chargeback may result in suspension of the affected service while the matter is investigated.

A good-faith dispute does not automatically establish fraud. Nothing in this Agreement restricts your legal rights to dispute unauthorized or incorrect transactions.

If payment is reversed or determined to be unauthorized, XeniaCore may revoke the affected service and associated resources, subject to applicable law and any mandatory notice or dispute-resolution requirements.

11. Suspension and Termination

XeniaCore may suspend or terminate a purchased service for nonpayment, fraud, material policy violations, serious security threats, unlawful activity, or other grounds permitted by the Terms of Service.

Where reasonably practicable, we will provide notice and an opportunity to remedy the issue. Immediate action may be necessary for serious abuse, active attacks, fraud, or other urgent risks.

Following termination, access to the service may be removed and associated resources may be reclaimed.

12. Hosted Data and Backups

You retain whatever ownership rights you have in your hosted content, subject to applicable third-party rights.

You authorize XeniaCore to store and process that content as reasonably necessary to provide and secure your purchased service.

Unless backup services are expressly included in your plan or agreed to in writing, you are responsible for retaining independent copies of your files, game worlds, websites, databases, and bot configurations.

XeniaCore does not guarantee that data can be recovered after cancellation, expiration, suspension, termination, or an infrastructure incident.

Data handling and retention are also governed by our Privacy Policy.

13. Changes to Services

We may make reasonable changes to infrastructure, software, network arrangements, or service delivery when necessary to maintain security, improve reliability, or continue operating our business.

We will make reasonable efforts to communicate material changes that significantly affect an active purchased service when appropriate.

We will not use this provision to eliminate rights or obligations that cannot legally be removed.

14. Disclaimer of Warranties

To the maximum extent permitted by law, services are provided on an "as available" basis.

XeniaCore does not warrant uninterrupted operation, error-free service, compatibility with every third-party application, or the recovery of customer data unless expressly agreed in writing.

Any warranties or consumer protections that cannot legally be excluded remain unaffected.

15. Limitation of Liability

To the maximum extent permitted by applicable law, XeniaCore will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, business opportunities, goodwill, or data.

To the maximum extent permitted by law, XeniaCore's aggregate liability relating to a purchased service will not exceed the fees paid to XeniaCore for that service during the three months preceding the event giving rise to the claim.

This limitation does not apply to liabilities that cannot legally be excluded or limited.

16. Governing Law

This Agreement is governed by the laws of the State of Georgia, United States, except where mandatory law provides otherwise.

Disputes may be brought before a court of competent jurisdiction in Georgia, subject to applicable consumer protections and mandatory jurisdictional rules.

Nothing in this Agreement waives rights or remedies that applicable law requires to remain available.

17. Relationship to Other Policies

This Agreement must be read together with:

  • XeniaCore Terms of Service.
  • XeniaCore Privacy Policy.
  • XeniaCore Fair Use Policy.
  • The service plan and order confirmation.
  • Any additional terms expressly presented and accepted during checkout.

If provisions conflict, the applicable order-specific terms control only where expressly stated, clearly disclosed, and legally enforceable. Mandatory legal requirements always take precedence.

18. Amendments

XeniaCore may update this Agreement for future purchases and, where legally permitted, existing services.

Updated versions will be published with a revised date. Material changes affecting existing purchases will be handled in accordance with applicable law, including any required notice or consent.

The version presented during checkout and accepted for a particular order should be retained as evidence of the agreement applicable to that purchase.

19. Electronic Acceptance and Records

You agree that electronic records and electronic acceptance may be used for transactions with XeniaCore to the extent permitted by applicable law.

XeniaCore may retain records of the applicable Agreement version, order details, timestamp of acceptance, account identifier, and payment confirmation for contractual, operational, and legal purposes.

An electronic record is not automatically proof of valid acceptance in every circumstance. XeniaCore's checkout process should clearly present the relevant terms and record the customer's affirmative action.
